Summary of conduct Mr Tait charged executors commission in respect of two estates without the fully informed consent of the beneficiaries failed to properly advise one client about his appointment as executor and failed to advise a further client in writing about his appointment as executor. Order: Pursuant to Section 299(1) of the Uniform Law the Victorian Legal Services Commissioner has decided that Mr Tait has engaged in unsatisfactory professional conduct and makes the following orders i. Mr Tait is reprimanded pursuant to section 299(1)(b) of the Uniform Law; and ii. Mr Tait is ordered pursuant to section 299(1)(e) of the Uniform Law to undertake two (2) CPD units additional to the standard requirements within six months of the date of the determination with at least one unit in relation to ethics and professional responsibility in wills and estates practice.
