Professional misconduct under the Legal Profession Uniform Law (Vic)

Penalty

1 The respondent is suspended from practice for a period of three months to commence on 31 December 2020. 2 At the conclusion of the suspension period the following additional conditions are placed on the respondent's practising certificate for the period ending 30 June 2021: a the respondent not be authorised to receive trust money; b the respondent not be a signatory to a general trust account maintained by a law practice nor an authorised Statutory Deposit Account user. 3 Any practising certificate issued to the Respondent for the 2021-2022 and 2022-2023 practising years is to be subject to the additional conditions that: a the respondent not be authorised to receive trust money; b the respondent not be a signatory to a general trust account maintained by a law practice nor an authorised Statutory Deposit Account user. 4 The respondent undertakes to the Tribunal and the Applicant to not work for eCollect.com.au Pty Ltd (eCollect) or any related entity or associate (as those terms are defined in the Corporations Act 2001 (Cth)) of the law practice or eCollect for the period of the suspension in any capacity paid or otherwise. 5 The respondent is reprimanded. 6 Before 31 March 2022 the respondent must complete five points of continuing professional development in the area of Ethics and Professional Responsibility which is to be in addition to his existing mandatory professional development requirements. 7 The respondent is to pay the Applicant's costs of the proceeding fixed by the Tribunal in the agreed sum of $18000.00.
