1.Andrew Bell (the respondent) is reprimanded. 2.The respondent is suspended from practice for a period of three months to be served concurrently with the immediate suspension period ordered in J122/2018. 3.Before 30 April 2021 he must complete two points of continuing professional development in the area of ethics additional to his ordinary professional development requirements and additional to the three points the subject of the orders in J122/2018. 4.The respondent is to pay the costs of the Commissioner which in default of agreement are to be assessed by the Costs Court.

Penalty

1. Andrew Bell (the respondent) is reprimanded. 2. The respondent is suspended from practice for a period of 12 months six months of which is to be suspended (suspended period) for a period of three years from the date of these orders (suspended order period) and six months of which (the immediate suspension period) is to commence on 18 May 2020. 3. During the suspended order period a local practicing certificate may be granted to the respondent. 4. During the suspended order period the respondent shall not engage in or commit any act of professional misconduct or unsatisfactory professional conduct. In the event that the respondent fails to comply with this order during the suspended order period the Victorian Legal Services Commissioner (the Commissioner) may make application to the Tribunal to revoke the suspended order period. On such application if the Tribunal is satisfied that a material breach of this order has occurred during the suspended order period and is satisfied that it is appropriate in all the circumstances the respondents practising certificate will be cancelled and a local practising certificate not granted to the respondent before the expiry of six months from the date of cancellation or six months and any further period that the Tribunal may determine having regard to the circumstances of the breach of the order. 5.Before 30 April 2021 the respondent must complete three points of continuing professional development in the area of ethics additional to his ordinary professional development requirements. 6.The respondent is to pay the costs of the Commissioner which in default of agreement are to be assessed by the Costs Court.
