Professional misconduct under the Legal Profession Uniform Law (Vic) + Unsatisfactory professional conduct under the Legal Profession Uniform Law (Vic)

Penalty

Pursuant to sections 297(1)(a) and (b) and 298 (a)(b) and (c) of the Legal Profession Uniform Law (Victoria) the Victorian Civil and Administrative Tribunal found Mr Guss guilty of seven charges of professional misconduct and one charge of unsatisfactory professional conduct. The Tribunal made orders: 1. Reprimanding Mr Guss; 2. Imposing a suspension period of a total of 19 months (to be served concurrently with the disqualification period at 3.); 3. Cancelling Mr Guss practising certificate and disqualifying him from applying for a practicing certificate for 5 years; 4. Recommending that Mr Guss name be removed from the roll of practitioners kept by the Supreme Court; 5. Requiring Mr Guss pay the costs of the Victorian Legal Services Commissioner.
