Public comment sought – Draft Rule on indexing cost disputes

The Legal Services Council seeking public comment on a draft Uniform General Rule to introduce indexation to consumer matters involving legal costs (see s 471 of the Uniform Law).
Since the Uniform Law commenced on 1 July 2015, there have been no Uniform Rules relating to indexation. Consumer matters involving costs therefore do not make an allowance for inflation. The introduction of indexation will maintain the Victorian and NSW Legal Services Commissioners’ jurisdiction to determine costs disputes in line with official inflation rates.
Following the consultation process and subsequent approval by the Standing Committee, the Council expects a new Uniform Rule may take effect from 1 July 2019.
